Early Access Terms

These Early Access Terms ("Early Access Terms") apply to your use of any Sonos feature currently provided on an Early Access basis (“Early Access Feature”). Sonos identifies Early Access Features as such on the applicable product page, in the Sonos app, and/or in accompanying marketing materials. These Early Access Terms supplement, and should be read together with, Sonos’ Terms of Use, License and Warranty Agreement and Privacy Statement (“Main Terms”) and, where applicable, any feature or service specific terms (such as Sonos Radio or Sonos Voice Control). By activating and/or continuing to use the Early Access Feature, you agree to these terms:

1. Early Access Feature. The Early Access Feature is still being developed and its functionality, reliability, and availability may differ from Sonos's generally released features.

2. System Requirements. The Early Access Feature may have other requirements, such as WiFi, setup through the Sonos app and/or other compatible Sonos products. Please see the applicable product page for a complete description.

3. Optional Feature. The Early Access Feature is an optional feature of your Sonos system. You can turn it on or off at any time in the Sonos app, except where a specific Early Access Feature is identified as required for setup or core functionality of a product you have purchased, in which case the applicable product page will say so, and there is no obligation to use the feature. You understand and agree that your use of any Early Access Feature is voluntary and does not create a legal partnership, agency, or employment relationship between you and Sonos, and neither you nor Sonos has any authority to bind the other.

4. As-Is; No Warranty. EXCEPT AS OTHERWISE REQUIRED BY APPLICABLE LAW, THE EARLY ACCESS FEATURE IS PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

5. Limitation of Liability. EXCEPT AS OTHERWISE REQUIRED BY LAW, YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF AN EARLY ACCESS FEATURE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND IN ADDITION TO THE LIMITATIONS IN THE SONOS TERMS OF USE, SONOS WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, AN EARLY ACCESS FEATURE. BECAUSE EARLY ACCESS FEATURES ARE MADE AVAILABLE AT NO ADDITIONAL CHARGE, SONOS'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES RELATED TO AN EARLY ACCESS FEATURE WILL NOT EXCEED THE GREATER OF (A) FIFTY U.S. DOLLARS (US$50) OR THE EQUIVALENT IN LOCAL CURRENCY, OR (B) THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW, EXCEPT AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY. NOTHING IN THESE EARLY ACCESS TERMS EXCLUDES OR LIMITS SONOS'S LIABILITY, OR AFFECTS YOUR STATUTORY RIGHTS, WHERE AND TO THE EXTENT SUCH EXCLUSION OR LIMITATION IS NOT PERMITTED UNDER APPLICABLE LAW, INCLUDING WHERE YOU ARE A CONSUMER RESIDENT IN THE EUROPEAN UNION, THE UNITED KINGDOM, OR ANY OTHER JURISDICTION WITH MANDATORY CONSUMER PROTECTIONS THAT CANNOT BE WAIVED BY CONTRACT. IN SUCH CASES, SONOS'S LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED UNDER THE LAWS APPLICABLE TO YOU.

6. Changes; No Obligation to Continue. Sonos may modify, limit, suspend, or discontinue the Early Access Feature, or any part of it, at any time and without notice, and is under no obligation to release, maintain, or complete any particular capability of the Early Access Feature.

7. Not a Basis for Purchase. Sonos makes no guarantee that the Early Access Feature will be a temporary or permanent part of any Sonos product offering. Purchasing decisions should not be made on the basis of the expectation that the Early Access Feature is, or will continue to be, available or that it will perform in any particular way.

8. Feedback. If you choose to share feedback about the Early Access Feature with Sonos, that feedback is owned by Sonos. This applies to feedback shared through any means, including but not limited to: the Sonos app, customer support, a survey, and social media comments. To the extent any ownership right in your feedback cannot be assigned, you hereby grant Sonos a worldwide, perpetual, irrevocable, royalty-free licence to use, reproduce, modify, and incorporate such feedback for any purpose, without obligation or compensation. Any personal data contained in your feedback (for example, if your feedback includes a voice recording, screenshot, or account details) will be handled in accordance with Sonos’ Privacy Statement, and this licence does not expand Sonos' rights to process such personal data beyond what the Privacy Statement and applicable law permit.

9. Updates to Terms. Sonos may update these Early Access Terms from time to time, subject to the terms established in the Main Terms.

10. Additional Terms. If there is a conflict between these Early Access Terms and the Main Terms with respect to an Early Access Feature, these Early Access Terms control, except for - the extent applicable - that the dispute resolution, arbitration, governing law, and class action waiver provisions of the Main Terms (and, where applicable, the Sonos Voice Control Terms of Use) continue to apply in full to any dispute arising out of or relating to an Early Access Feature. If any provision of these Early Access Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. Sonos's failure to enforce any provision of these Early Access Terms will not be considered a waiver of that or any other provision.
